The following information describes regulatory procedures for siting marine and hydrokinetic (MHK) projects in Massachusetts state waters, which generally include the seabed, submerged lands, and waters extending three nautical miles seaward from shore. For a description of the Scope, Organization and Commonly Used Terms, please refer to the Introduction. Like most energy facilities, marine and hydrokinetic projects are developed in phases. Site assessment is the first step, and once a site is selected the authorization (i.e., permitting and licensing) process begin. Note: The regulatory framework pertaining to offshore activities is experiencing relatively rapid change, as evidenced by the development of the Massachusetts Ocean Management Plan and the recently updated Massachusetts Coastal Management Program. While the particular authorizations required for ocean renewable energy projects are not necessarily expected to change, the review processes for these authorizations may vary as new and revised policies regulations are implemented. Project proponents are strongly encouraged to schedule a pre-application meeting with regulators prior to initiating the permitting process.
